Dual Citizenship Kyrgyzstan

Pursuant to the Citizenship Act, the citizenship of the Kyrgyz Republic can be obtained on the following grounds: as a result of birth; as a result of acceptance into citizenship of the Kyrgyz Republic; as a result of restoration in citizenship; and on the grounds or in accordance with the procedure envisioned by international treaties to which the Kyrgyz Republic is a party.

Pursuant to the Constitution, the citizens of the Kyrgyz Republic are considered to belong to the citizenship of another state in accordance with the laws of the Kyrgyz Republic and international treaties to which the Kyrgyz Republic is a party. Pursuant to the Citizenship Act, acquisition of another citizenship by a Kyrgyz citizen does not entail the termination of the citizenship of the Kyrgyz Republic. The Kyrgyz Republic considers a Kyrgyz citizen having another citizenship only as a citizen of the Kyrgyz Republic, unless otherwise provided for by international treaties in force to which the Kyrgyz Republic is a party.

The Citizenship Act provides for cases in which a Kyrgyz citizen may obtain a citizenship of another state, while maintaining the citizenship of the Kyrgyz Republic, which are as follows:

  • in case the obtainment of the citizenship of another state is not in contradiction with the laws of the Kyrgyz Republic and those of a foreign state;
  • in case there are international treaties in force on the issues of dual citizenship to which the Kyrgyz Republic is a party.

Although the dual citizenship status is recognized by both the Constitution and the Citizenship Act, the acquisition and recognition of such status is limited as there are currently no international treaties in force that would provide the legal regime and grounds for recognition of dual citizenship status in the Kyrgyz Republic.

A citizen of the Kyrgyz Republic with dual citizenship cannot serve as the President of the Kyrgyz Republic, a member of the Parliament, a judge, a law-enforcement officer, an army officer, an employee of the authorized state body of the Kyrgyz Republic in the field of defence and cannot occupy any managerial positions in the government agencies of the Kyrgyz Republic. Moreover, it shall be noted that the Kyrgyz Republic does not recognize dual citizenship for the citizens of bordering states (i.e. the citizens of China, Kazakhstan, Tajikistan and Uzbekistan), as well as for those who are not eligible for acceptance into citizenship of the Kyrgyz Republic on the grounds specified by law.
