The modalities of attribution and acquisition of nationality according to Cape Verdean law are:
The modalities for acquiring Cape Verdean nationality do not oppose dual nationality, however, in order to provide for cases of conflicting nationality, the law states that “If an individual has two or more nationalities and one of them is Cape Verdean, only the latter shall prevail under Cape Verdean law” and “If an individual has two or more foreign nationalities, the nationality of the state in whose territory the plurinational is habitually resident shall prevail or, in the absence thereof, that of the state with which he or she maintains the most effective link.”
The law stipulates that a child, grandchild, great-grandchild or great-great-grandchild of a Cape Verdean is a Cape Verdean of origin, born abroad, if they declare that they want to be Cape Verdean, (This must be registered with the Central Registry Office.)
The law also provides for nationality of origin by choice, under which Cape Verdean nationality is acquired by choice.
A child born in Cape Verde to foreign parents is eligible for Cape Verdean nationality unless they explicitly declare otherwise, provided that:
